The Constitution, in section 28(1)(g) is obvious relating to the detention of children: it should be used as a live of expedient and for the shortest acceptable amount of time. jurisprudence additionally places robust stress on proscribing the employment of
detention for youngsters. Article 37(b) of the UNCRC has similar formulation to it of section 28(1)(g) of the Constitution:
‘No child shall be empty his or her liberty unlawfully or randomly. The arrest, detention or imprisonment of a baby shall be in conformity with the
law and shall be used solely as a live of expedient and for the shortest appropriate amount of time’
